PERSONAL DATA PROCESSING INFORMATION

Since May 25, 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as “GDPR”) has been applicable in all European Union countries. In connection with the above, and out of concern for the protection of your personal data, we present the following information regarding the processing of personal data collected within the Softtutor Consulting Sp. z o.o. website.

PURPOSES AND LEGAL BASES OF PROCESSING

We will process your personal data primarily in connection with the performance of a legal obligation incumbent on the data controller (Article 6(1)(c) of the GDPR) or in connection with the performance of tasks carried out by the data controller in the public interest or in the exercise of official authority vested in the controller (Article 6(1)(e) of the GDPR).

Your personal data may also be processed on the basis of your freely given consent; in such a case, you may withdraw your consent at any time (Article 6(1)(a) of the GDPR). However, the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Withdrawal of consent or refusal to grant it will result in the data controller not processing your data for the purposes resulting from the consent.

Personal data may also be processed if it is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (Article 6(1)(b) of the GDPR).

The information on the processing of personal data by Softtutor Consulting Spółka Sp. z o.o. applies, among others, to data received:

  • via electronic forms,
  • under contracts with clients (contact details only) in the scope of purchasing, sales, or marketing activities (e.g., as part of business meetings or correspondence, during conferences or other events, tenders, negotiations, etc.).

Personal data may be processed for the purposes of the recruitment process. Filling out the recruitment form is equivalent to consenting to the processing of personal data for the purposes of current and future recruitment processes conducted by Softtutor Consulting Sp. z o.o. on the basis of Article 6(1)(a) of the GDPR for a period not exceeding 24 months.

Softtutor Consulting Sp. z o.o. may receive contact details directly from the data subject (e.g., via electronic forms) or through other persons (e.g., from an employer, another employee, or another entity with whom the person permanently cooperates).

In the case of direct contact, you have full control over the scope of data provided to Softtutor Consulting Sp. z o.o.

If the data is shared by another person, Softtutor Consulting Sp. z o.o. usually collects only basic contact details related to professional activity, including: first name, last name, e-mail address, telephone number, position or job title, company, and possibly other data resulting from the contract or order in connection with which the contact person’s personal data is shared.

  • answering inquiries
  • media contact and promotion of activities, services, and products in the media
  • compliance with the legal obligation to prepare and store documentation
  • confirmation of performance of obligations, as well as establishing, pursuing, or defending against claims

You have the right to object to such processing of your personal data.

DATA RETENTION PERIOD

We will process your personal data for the duration of the task for which the personal data was collected, and subsequently, it will be stored in accordance with the provisions of the Act of July 14, 1983, on the National Archival Asset and Archives (Journal of Laws of 2018, item 217, as amended) and provisions issued on the basis of Article 6(2) of the aforementioned Act for a period not exceeding 24 months.

YOUR RIGHTS

In accordance with the provisions of the GDPR, you have the right to:

  • access your data;
  • rectify your data;
  • erase your data;
  • restrict the processing of your data;
  • data portability;
  • object (when the processing is based on the legitimate interest of the controller);
  • withdraw consent (when the processing is based on consent).

The exercise of these rights depends on the conditions specified in the GDPR. In the event of a refusal to grant the request, you will receive a response with the justification for the refusal. In many cases, the software used to browse websites (web browser) allows for the storage of cookies on the user’s terminal device by default.
